Terms of Service ("Terms")

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using e-mesg service (the "Service") operated by e-mesg ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply users who access or use the Service.

IF YOU USE THE SERVICE, YOU CONSENT TO THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT USE THE SERVICE AND NOTIFY US IMMEDIATELY TO CANCEL SERVICE.

Rates

By signing up, your account will be billed every 30 days at the rate of your current plan until you cancel the Service. Your account will terminate immediately upon cancellation and you will forfeit any remaning balance on your account. All fees are non-refundable.

Service

e-Mesg takes your account information very seriously. All information in encrypted and our server is maintained with the heighest level of security. However, while we try our best to protect your privacy, e-Mesg cannot be held in any way liable in the event of a security breach or if your personal data is compromised.

Furthermore, e-Mesg shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through our services.

e-Mesg is intended for use solely for personal use. e-Mesg makes no guarantees that all your emails will be delivered, and cannot be held responsible in any way for any damages that result because of failed email delivery.

Usage of e-Mesg is solely at your own risk, with the knowledge that e-Mesg stores email account credentials on their private server. Additionally, by using this service, you agree not to hold e-Mesg in any way responsible for any consequence as a result of failed email delivery, incomplete emails or any other e-Mesg service failure.

You agree not to use the service for any unlawful, unauthorized or abusive purpose or in any way that damages our property or others' property, or interferes with, harms or disrupts our system or other operators' systems or other users

Our Services display some content that is not our own. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it voilates our abuse policy and refuse to display such content.

Abuse

By using our search features you agree to use them in a way which does not constitute an abuse of our service. e-Mesg has the right do define what constitutes abuse, and will inform you when you have used the service in an abusive manner. e-Mesg will not take action before infoming you that our terms have been breeched. If you do not desist the abusive action, this constitutes a breech of terms and e-Mesg will ban your account from using search features or terminate your account as set forth in the Termination clause.

Oauth Scopes

to link your email account to e-Mesg service, we request restricted scopes for full email access to your account. The reason we require this scope, is to allow e-Mesg to access your email account on your behalf, to read your emails when you request them, delete emails that you specify, and to send out an email via REPLY, FORWARD or COMPOSE commands. This allows you a greater flexibilty in managing your inbox through our service.

Privacy

e-Mesg collects information to better service our users. We may use this information for analysis or diagnosis purposes. All communication with our system (incoming and outgoing) is logged and stored. This includes your search queries, all uses of our features and the emails you specifically request, and compose. This information may be used, at your consent, to troubleshoot issues related to your service. However, we do not log or store any other emails that are sent to you, and do not access your email account for any other purpose other then to send you your emails. Information that we collect is never shared with other parties for any reason.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. You will not be refunded any fees. If you wish to terminate your account, you may simply discontinue using the Service.

Uber

e-Mesg uses dedicated uber accounts to enable subscribers to ride with uber without needing a personal uber account. e-Mesg charges a small fee for using this service in addition to a credit card processing fee. By using this service you agree to be held responsible for, and pay all charges or fees that e-Mesg incurres through uber on account of your ride, including cancellation fees, additional charges that were incurred as a result of incorrect estimates (even through an error on our part), waiting charges, or any other charge.

Additionally, by using this service, you agree to forfeit any and all rights to dispute any charges that e-Mesg charges your account for using this service. We reserve the right to fine users who abuse this service in any way, including, but not limited to, harrasing drivers, ordering rides and not taking them, providing incorrect information, or any other misuse of the service, in any way in which it was not intended to be used. Fines will begin at $50 for first offense, and increase by $10 for subsequent offenses. Additionally, e-Mesg reserves the right to deny any user access to this service at our sole discretion.

This service is provided at your own risk. In no event shall e-Mesg be held liable for any incidental or consequential, personal or monetary damages, arising out of or in connection with the use of this service, Including any loss as a result of a failure in the service preventing a user from ordering a ride

Governing Law

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
